• Medical and personal health information (such as medical and healthcare history, blood type, blood test results, images of teeth or gums, fingerprints, or hereditary characteristics, DNA, health and mental condition, diagnosis, medication and drugs prescribed);
• Any correspondence sent to us via email or otherwise;
• Details of visits to our site and the resources that you access (which may include, amongst other things; traffic data and communication data) from your/the device logged on by you or anyone logged in as you;
• Details of purchases made on the site;
• Images submitted to Biota Excel in relation to the usage of Biota Platforms whether or not part of our service;
• Health Data provided and submitted in relation to the usage of Biota Platforms whether or not part of our service;
• User-generated content in relation to the use of Biota Platforms; and
• Device and usage information in relation to the use of Biota Platforms.

2. Disclosure of Your Information

A. We use your information in the following ways:

• To manage, verify and complete transactions with you;
• To manage, verify and complete services we agree to provide to our users;
• To analyse and understand your medical health and trends and provide information or insights in relation to the information we collect about you and your health;
• To improve our Artificial Intelligence (“AI”) models we use in relation to providing our services to our end-users;
• To manage, verify and complete any registration for packages, promotions, marketing drives and contests (where applicable);
• To enable you to participate in promotions and contests;
• To ensure that our website’s content is presented as effectively as possible for you;
• To improve our services;
• For our internal purposes, such as site performance, system administration, quality control and to evaluate use of our website, so that we can provide you with better services;

This is statistical information about our users’ browsing actions and patterns and does not identify any individual.

C. Any Personal Data supplied by you will be retained by us as long as necessary for the fulfilment of the Purposes stated in paragraph (2) A. and B. above or as is required to satisfy legal regulatory, accounting requirements or to protect our interests.

D. We will validate data provided using generally accepted practices and guidelines. This includes the use of check sum verification on some numeric fields such as account numbers or credit card numbers. In some instances, we are able to validate the data provided against pre-existing data held by the Company. In some cases, Biota Excel is required to see original documentation before we may use the personal data such as with Personal Identifiers and/or proof of address.

E. Personal Data held by Biota Excel will be kept confidential but we may transmit, provide or disclose such data / information to the following parties (whether within or outside Malaysia): –

1. OpenAI, a third-party service provider operating the AI system, for the following purposes: –
   • To generate AI-powered responses to your queries;
   • To enable user experience improvements via model training (with anonymized or aggregated data, where possible); or
   • To improve our AI models for future training.

   • Limitation of Liability: While reasonable safeguards are in place, the use of third-party AI systems entails some inherent data risks.

3. Biota Excel’s agents, servants, workers and/or such persons; and
4. Professional advisers, Medical Officers, Doctors, Dentists, Consultants and/or Specialists engaged and appointed by Biota Excel.

3. Security of Information

A. All your information is stored on secure cloud servers provided to us by third-party vendors with encryption in transit and in rest and any access to the information is restricted to authorized personnel only. We do not and will not sell your personal and private data. However, anonymized and aggregated data may be used for analytics, research or trend reports and information. Any payment transactions will be encrypted by established third party payment gateways. Continuing usage of this website will constitute consent of the storage of your information in the manner disclosed herein. If you have a username, password or other login details which enable you to access certain parts of our site, you must not allow any other person to use them and must treat them as confidential. B. Unfortunately, however, the transmission of information via the internet is not completely secure. Biota Excel shall use reasonable and practical measures to safeguard your Personal Data against unauthorized access, disclosure, misuse, or alteration. However, Biota Excel shall not be held liable for unauthorized disclosures resulting from breaches beyond its reasonable control. Although we will apply reasonable safety procedures and comply with legal requirements to protect your information, we cannot guarantee the security of your information transmitted to our site and any transmission is at your own risk. Once we have received your information, we endeavour to use proper procedures, methods and security features to try to prevent unauthorized access but we do not assume responsibility for any breach of security should it so happen. Registration and continued use of Biota Platforms constitutes your unequivocal agreement not to hold us liable for the loss, misuse, disturbance or dissemination of your private data should it happen whether known or unbeknownst to us.

C. Our site may from time to time contain links to and from other websites for your convenience only. Please note that we are in no way affiliated to those third-party websites and will not have any control over them and their Terms of Use and Privacy Policy. Therefore, we shall under no circumstance, be liable or responsible for any loss or damages or consequences arising from the use or misuse of those websites and neither will we be liable or responsible for any Personal Data you share with those websites. A. Where such a transfer is performed, it will be done so in accordance with this Privacy Policy and our Terms of Use, and local legislation such as the Personal Data Protection Act 2010.

B. If you are an existing customer, we may contact you through email and/or SMS with information about products and services which we feel you might be interested in, unless you have requested that you do not want to receive them.

C. If you are a new customer, we may contact you by email, Whatsapp and/or SMS.

8. Your Right of Access to Personal Data

A. Under the Act, you have the right to access your Personal Data held by us at any time and to request correction of the Personal Data that is inaccurate, misleading, incomplete or not up-to-date. You also have the right to withdraw your consent to use your Personal Data and for us to directly contact you regarding future marketing. You also have the right to delete your account on Biota Excel and request deletion of all your data from Biota Platforms. Biota Excel is committed to ensure that your rights under the Act are protected. You may do the following at any time:

• Requests to access or correct Personal Data will be responded to promptly, generally within 21 working days, in accordance with the PDPA; and

9. Changes to Privacy Policy and Terms of Use

A. We reserve the right to amend this Privacy Policy from time to time without prior notice and your continued usage of Biota Platforms constitutes acceptance of this right. Any changes to the Privacy Policy will be uploaded onto Biota Platforms and therefore, we encourage you to check/visit the Website from time to time for any changes on a regular basis.
